MINUTES OF THE REGULAR MEETING
FORREST CITY CITY COUNCIL
FORREST CITY, ARKANSAS
July 5, 2016
The City Council of Forrest City, Arkansas met in regular session on July 5, 2016. Mayor Bryant called the meeting to order at 6:00 p.m. Alderman Williams offered prayer after which the Pledge of Allegiance was recited. The following answered roll call: Mayor Bryant, Clerk Cochran, Attorney Cline, and City Council members: Williams, Echols, Hollowell, Breeding, Twillie, Fields, Capps, and Oswalt.
Mayor Bryant requested that donation of property – Joey Astin under new business be moved up to number one position on the agenda because Mr. Astin has another engagement. Motion Alderman Fields. Second by Alderman Echols. Roll Call: All Ayes.
Alderman Fields made a motion to approve the minutes of June 21, 2016 regular meeting. Motion second by Alderman Oswalt. Roll Call: All Ayes.
Alderman Williams made a motion to approve the minutes of the special meeting on June 30, 2016. Second by Alderman Fields. Alderman Field asked if the calculations on Mr. Hamilton’s case were correct because the Little Rock meeting the figures were different. Roll Call: All Ayes.
REPORT OF COMMITTEES
DEPARTMENT HEADS REPORTS
Park and Recreation Booking Fees Refund
Alderman Oswalt stated the council dealt with the civic center booking refund fees a few meeting ago but did not include the recreation department. Alderman Oswalt then asked Attorney Cline if an ordinance or resolution should be passed since money is involved.
Alderman Oswalt also stated the council never put anything in writing, just a council roll call vote to change the civic center rates back.
Attorney Cline stated he would do a resolution if the Mayor’s office would get him the new rates.
An Ordinance to Increase Mosquito Control Rates
Attorney Cline read for the third reading of An ordinance Amending Section 13-34 of The Code of Ordinances (ordinance NO. 1528); Providing For Pest control; Setting A Fee of Three Dollars ($3.00) Per Month; And For Other Purposes sponsored by Alderman Echols.
Alderman Oswalt made a motion to adopt the ordinance. Second by Alderman Echols. Roll Call: All Ayes.
IT In A Box Computer Contract
Mayor Bryant told the council IT In A Box is offering the city a month-to-month contract as the IT technicians.
Donation of Property for Future Fire or Police station
Joey Astin with the St. Francis Area Developmental Center stated about a year ago the Fowler Family donated some property to their center on South Washington. He stated that the Area Developmental Center is not going to utilize all of the property. Mr. Astin stated he spoke with Mayor Bryant and the two alderman of that Ward. After some consideration, it was decided to donate some of that property to the city for dedicated use; either fire or police substation. He said there is no time constraint on the use of the property and the survey has already been paid.
Alderman Oswalt made a motion to accept the property from the St. Francis Area Developmental Center. Second by Alderman Fields.
Alderman Hollowell asked Mr. Astin whether or not the city would be allowed to use the property for anything other than the fire or police department. Mr. Astin stated because the property is being donated for a dedicated use, the city would have to use it for that purpose.
Mr. Astin did tell the council that the matter could be revisited in the future.
Alderman Capps asked how many acres is it? Mr. Astin stated 0.7 acres.

Mayor Bryant stated the council would do a formal resolution at the next meeting.
Request Permission to Advertise for Sale of the Forrest City Municipal Airport
Attorney Cline stated the city has received the approval it needed from the Federal Aviation Administration to advertise for bids to sell the city’s airport. He said the city has all appraisals and all ground work has been done. He said FAA wants the council to present plans whether it is by a formal vote or general census. Attorney Cline then stated the council needs to vote to advertise for bids to sell the Forrest City Municipal Airport.
Alderman Oswalt stated the final bids have to be approved by the City of Forrest City, DRAA, and the FAA. He then asked what happens if two of the three parties say yes and the other party say no.
Attorney Cline stated it would take all three entities to agree, because all three has a role. The City of Forrest City owns the airport, the DRAA will receive the funds, and The FAA because it is an FAA airport that is being built.
Attorney Cline then said the city is not getting any money out of it, so why would the city want to assume the responsibility. He said the city has a say in selling of the airport, but he does not want the city to be primarily responsible for deciding which bids to accept or not accept.
Alderman Hollowell made a motion to advertise for bids to sell the Forrest City Municipal Airport. Second by Alderman Oswalt. Roll Call: All Ayes.
Proposal to Provide Emergency Ambulance services to The Citizens of Forrest City
Mayor Bryant stated the city needs to advertise, requesting qualifications and or proposals.
Alderman Oswalt asked if the city has the authority to decide who gets the call when there is more that one ambulance service available.
Attorney Cline stated the city can set rules and regulation and set rates.
After further discussion, Alderman Oswalt made a motion accept RFQ’s for ambulance service for Forrest City. Second by Alderman Williams. Roll Call: All Ayes.
GENERAL FUND BILLS
Alderman Breeding made a motion to approve and pay the General Fund bills totaling $28,866.73 Alderman Williams second the motion. Roll Call: All Ayes.
Alderman Oswalt made a motion to approve and pay the Street Fund bills in the amount of 6,924.55 Alderman Echols second the motion. Roll Call: All Ayes.
Alderman Capps made a motion to approve and pay the Solid Waste fund bills in the amount of $3,438.78. Alderman Williams second the motion. Roll Call: All Ayes.
Alderman Breeding made a motion to approve and pay Water Utility bills in the amount of $44,092.23; excluding purchase order, not on the list, in the amount of $808.69 from Little Rock Wini Water Works. Second by Alderman Oswalt. Roll Call: All Ayes.
Alderman Echols made a motion to adjourn at 6:18 p.m. Second by Alderman Fields.
