MINUTES OF THE REGULAR MEETING
FORREST CITY CITY COUNCIL
FORREST CITY, ARKANSAS
March 22, 2016
The City Council of Forrest City, Arkansas, met in regular session on March 22, 2016. Mayor Bryant called the meeting to order at 6:00 p.m. Alderman Williams offered prayer after which the Pledge of Allegiance was recited. The following answered roll call: Mayor Bryant, Clerk Cochran, Attorney Cline, and City Council members: Williams, Echols, Hollowell, Breeding, Twillie, Fields, Capps, and Oswalt.
Alderman Echols made a motion to approve the minutes of March 1, 2016 regular meeting. Motion second by Alderman Fields. Roll Call: All Ayes.
REPORT OF COMMITTEES
DEPARTMENT HEADS REPORTS
Mayor Bryant asked if all council members read the procedural rules manual that is recommended by the Arkansas Municipal League, so the decision can be made whether or not the council wants to adopt the procedural rules to operate by. Alderman Oswalt stated he looked over the manual and the council is already following most of the rules, but he was concerned about all the different kinds of motions. He then stated the council was following the rules close enough without formally adopting the procedural rules manual.
Mayor Bryant said the council will continue to do what’s been done in the past, but there is nothing in writing to that effect.
Commissions and Other Appointments
Mayor Bryant stated he would like to re-appoint Ernestine Weaver and Chaney Murray to the Forrest City Civic Center commission. Alderman Oswalt made the motion. Second by Alderman Twillie. Roll Call: All Ayes.
Forrest City Planning Commission
Mayor Bryant stated he would like to re-appoint Glenda Wade to the Forrest City Planning Commission. Alderman Oswalt made the motion. Second by Alderman Williams. Roll Call: All Ayes.
Resolution to Amend the 2015 Budget
Attorney Cline read a Resolution Amending Resolution #948 Amending The 2015 Budget
Alderman Oswalt made a motion to adopt the resolution. Second by Alderman Fields.
Alderman Echols asked if the city water and library department heads salaries are included in the budget.
Mayor Bryant stated those salaries will be included in the 2016 budget, this resolution is to amend the 2015 budget. Roll Call: All Ayes.
An Ordinance Rezoning Property From Industrial to R-1 (Residential)
Mayor Bryant stated Brent Ponder is present requesting property rezoning from industrial to R-1 residential.

Sponsored by Alderman Capps. Alderman Capps made a motion to suspend the rules and read the ordinance for the second reading. Second by Alderman Oswalt. Roll Call: All Ayes.
Attorney Cline read the ordinance for the second reading by title and section only. Alderman Oswalt made a motion to suspend the rules and read the ordinance for the third reading. Second by Alderman Fields. Roll Call: All Ayes.

A Resolution Certifying the Amount of a Clean-up Lien to be Filed with St. Francis County Tax Collector
Attorney Cline read A Resolution Certifying the Amount of a Clean-up Lien to be Filed with St. Francis Tax Collector Against Certain Real Property in the City of Forrest City, AR
Attorney Cline asked if there were anyone present who wants to speak on the property in question. No one was present. Alderman Fields stated Mr. Millard spoke with her and said the property was cut in error, because Mr. Hines puts a garden on the property every year.
Mayor Bryant stated this issue can be resolved.
Alderman Oswalt asked that someone from Code Enforcement or Pest Control be present the next time there is a resolution or ordinance to answer questions.
Mayor Bryant stated these are nuisance abatement conditions not condemnations; he will get with J.C. Rice.
Alderman Oswalt made a motion to table the resolution until the next meeting. Second by Alderman Williams. Roll Call: All Ayes.
GENERAL FUND BILLS
Alderman Oswalt made a motion to approve and pay the General Fund bills totaling $21, 822.89. Alderman Twillie second the motion. Roll Call: All Ayes.
Alderman Fields made a motion to approve and pay the Street Fund bills totaling $2,534.99. Alderman Echols second the motion. Roll Call: All Ayes.
Alderman Breeding made a motion to approve and pay the Solid Waste fund bills totaling $32,874.18. Alderman Hollowell second the motion. Roll Call: All Ayes.
Alderman Twillie made a motion to approve and pay Water Utility bills in the amount of $74,015.12. Second by Alderman Williams. Roll Call: All Ayes.
State of The City’s Address
Mayor Bryant read his State of the City’s address (See attached).
Attorney Cline stated he did not know where the council stood on adopting the 2016 budget. An issue has come up at the Forrest City Library about the city council’s role in dealing with their finances. He said he did research and it appears to him that the state statute and city ordinance sets the facility to be ran by its board of directors. That includes the budgeting and salary structure; the city council should not have a role in that.
Alderman Twillie asked if the library was funded by the city. Attorney Cline said no the library has its own funding.
Alderman Breeding stated at the last budget meeting, salaries were discussed but no decisions were made; Alderman Echols was going to check into the legalities of making that decision.

Attorney Cline stated for years the library board has made recommendations for a budget to the city council for adoption alone with the city’s budget.
Mayor Bryant stated the library board makes decisions on all salaries and everything that goes on at the library, the council has no say, but the board is still obligated to abide by state laws on constructions and all projects.
Alderman Oswalt asked Clerk Cochran is it a requirement from the state auditors that a library budget be attached to the city’s budget for adoption. Clerk Cochran stated yes that is a requirement.
Alderman Echols asked how is it that the city council has taken control of the Forrest City Water Utility’s budget but not the library. Attorney Cline stated once the mileage was passed and a Municipal Public Library was setup, the statute states how libraries have to be ran; the Forrest City Water Utility falls under the city as though it is another department.
Alderman Echols made a motion to adjourn at 6:31 p.m. Second by Alderman Fields.
