MINUTES OF THE REGULAR MEETING

FORREST CITY CITY COUNCIL

FORREST CITY, ARKANSAS

September 15, 2015

The City Council of Forrest City, Arkansas, met in regular session on September 15, 2015. Mayor Bryant called the meeting to order at 6:00 p.m. Alderman Twillie offered prayer after which the Pledge of Allegiance was recited. The following answered roll call: Mayor Bryant, Records Clerk Manning, Attorney Cline and City Council members: Twillie, Williams, Echols, Fields, Hollowell, Capps, Breeding, and Oswalt. City Clerk Cochran were absent.

Alderman Capps made a motion to approve the September 1, 2015 regular meeting minutes. Second by Alderman Williams. Roll Call: All Ayes.

Bid Opening Civic Center Caterer

Mayor Bryant asked if there were any bids in the audience; there were none. Two bids were opened. M & M Catering from Forrest City, Arkansas and Dywarn Barden-Dawson from Forrest City, Arkansas. The Mayor stated that he will pass the bids on to the Civic Center Commission to make a recommendation.

Forrest City Area Wellness and Athletic Consortium (FCAWAC)

Dr. Stuart Towns reported that the FCAWAC met and he wanted to give an update. A handout was passed out to the council. Dr. Towns stated that FCAWAC met and interviewed the firms that applied for the construction manager position for the track and pool project. Their recommendation was for Baldwin & Shell Construction Company to be selected. Dr. Towns stated that John S. Copas, President & CEO of Baldwin & Shell Construction Company and Rick Terry, President of the Northeast Division of Baldwin & Shell were present and could answer any questions that the council might have. The 501c3 application has been summited and they are waiting for approval. After which, they are ready to move forward with their fund raising efforts.

Alderman Capps asked John S. Copas, President & CEO of Baldwin & Shell Construction Company, would they show a figure for preconstruction cost. Mr. Copas stated yes, it would be a part of their fee. Once an entire scope is determined they will negotiate on a fee and the fee will be separated in two. One will be preconstruction. It’s part of the fee not policy. Alderman Capps asked if it rolled in to general conditions. Mr. Copas stated no. Preconstruction in not a cost to be paid. It is part of their fee. Alderman Capps asked Mr. Copas if before the contract is signed the council will have a figure for preconstruction cost and general conditions. Mr. Copas stated that he didn’t know when the contract will be created. Mr. Copas continued by saying, normally they are hired under contract and the contract does not have a value because the drawing are not complete to determine value. If the drawings are complete, they will give a complete breakdown, but at any point, if they sign a contract and it has zero in it before the GMP (Guarantee Maximum Price) is determined, you will get a break down of all cost, not just general conditions. Mr. Copas went on to say that they were excited. They haven’t been in Forrest City since they restored the Holiday Inn about eight year ago. Their company will be 70 years old next year. They are the oldest construction company in Arkansas. Part of their presentation is, Arkansans working for Arkansans. The point is that in any given year they never fall below 80 percent repeat clients. Mr. Copas stated that he gave the committee (FCAWAC) his guarantee the Rick Terry, President of the Northeast Division of Baldwin & Shell and his group will do everything and more than what is expected for this project.

GENERAL FUND BILLS

Alderman Oswalt made a motion to approve and pay the general fund bills totaling $23,298.45. Alderman Twillie second the motion. Roll Call: All Ayes.

STREET FUND BILLS

Alderman Hollowell made a motion to approve and pay Street Fund Bills in the amount of $7,396.78. Alderman Williams second the motion. Roll Call: All Ayes.

SOLID WASTE FUND BILLS

Alderman Breeding made a motion to approve and pay Solid Waste Fund Bills in the amount of $41,672.72. Alderman Williams second the motion. Roll Call: All Ayes.
