Regular Meeting Minutes for January 6, 2015

The City Council of Forrest City, Arkansas, met in regular session on January 6, 2015. Mayor Bryant called the meeting to order at 6:00 p.m. Alderman Twillie offered prayer. The following answered roll call: Mayor Bryant, Records Clerk Manning, Attorney Cline and City Council members: Capps, Echols, Hollowell, Williams, Oswalt, Twillie and Fields. Alderman Breeding and City Clerk Cochran was absent.

Mayor Bryant stated the first order of business is the organization and the function of the City Council.

Alderman Echols made a motion (recommended) that they leave the Personnel Committee and the Budget Committee as they are and all the other standing committees leave them as well, with the only change being is to replace Alderman Peacock with Alderman Williams. Second by Alderman Twillie. Discussion, Alderman Breeding asked what was the breakdown of the committees, how many people was on each one. He stated that there were supposed to be four on each committee which consist of one from each ward. Alderman Twillie stated that on the personnel committee it was four, but when it came to the budget committee it was four plus one because the Mayor Pro Tem was serving on the finance/budget committee. Alderman Breeding said in the past there has always been one member from each ward and he wanted to keep the same approach used in the past. Alderman Echols asked Alderman Breeding, would they included the addition of the Mayor Pro Tem. Alderman Breeding said no, with the exception of him serving on the one committee, there was no need for him to serve on two committees. Alderman Breeding suggested that if any committee meeting is held notify the press in the time that is allotted, least 2 hrs. Notice, and that any committee member have as much advance notice as possible preferably in writing with an agenda.

Alderman Hollowell stated that the council had a summitted recommendation for the organization and that he would like to summit it to be approved. Alderman Echols asked to have time to look over the handout. Alderman Oswalt said that he preferred that all the council members look over it for the next meeting. Alderman Breeding asked if they were going to wait on all that was recommended for the next meeting or was it going to be voted on tonight. Alderman Echols said that she wanted her recommendations to be voted on tonight.

Attorney Cline stated the one thing that needed to be done was the election of the Mayor Pro Tem. The committee assignments did not necessarily have to happen that night but the nomination and the election of Mayor Pro Tem, according to the statute, had to happen at the first meeting. After discussion, Alderman Echols moved to table the current motion for a couple of minutes.

Alderman Echols made a motion (recommended) to keep Alderman Twillie as Mayor Pro Tem. Second Oswalt. Roll Call: Alderman Twillie, Echols, Fields, Hollowell, Capps, Breeding, Oswalt, and Williams. Votes: All Ayes.

Alderman Echols stated that her motion (recommendation) is that the Personnel Committee and the Budget Committee remain as they were last year with the exception that we include a fourth member from the ward that is missing. After discussion, Alderman Echols made a motion (recommended) they keep the Finance Committee, the Budget Committee, the Personnel Committee as they were last year, all members being the same. All other committees remain the same, Civic Center, A&P etc... with the exception that Alderman Peacock is replaced with Alderman Williams. Second Twillie. After Discussion, Roll Call: Alderman Twillie-Abstained, Alderman Echols-Yes, Alderman Fields-No, Alderman Hollowell-No, Alderman Capps-No, Alderman Breeding-No, Alderman Oswalt-Yes, Alderman Williams-Yes. Votes: One-Abstain, Three-Yes, Four-No. Motion Failed.

Alderman Oswalt made a motion that the Finance Committee consist of one council member from each ward, the Personnel Committee consist of one council member from each ward, with the appointments being as follows for the Finance Committee: Alderman Twillie, Alderman Echols, Alderman Breeding and Alderman Hollowell and on the Personnel Committee: Alderman Williams, Alderman Capps, Alderman Fields and Alderman Oswalt. Second by Alderman Fields. After discussion, Roll Call: Alderman Twillie-Yes, Alderman Echols-Yes, Alderman Fields-Yes, Alderman Hollowell-Yes, Alderman Capps-Yes, Alderman Breeding-Yes, Alderman Oswalt-Yes, Alderman Williams-Yes., Votes: All Ayes.

Alderman Oswalt moved to approve the December 16, 2014 minutes. Alderman Echols second the motion. All: Ayes. Alderman Breeding-Abstained.

REPORT OF COMMITTEES

Budget Committee

Alderman Twillie stated that the budget committee met twice in December and at each meeting they tried to arrive at an equitable budget. Alderman Twillie stated that he had asked Alderman Echols to serve as secretary for the budget committee and that the committee had recommendations. Alderman Echols read the recommendations to the council and mentioned the memos. See attached. Mayor Bryant asked what the pleasure of the council was. Alderman Breeding expressed concerns regarding the recommendations. Attorney Cline stated that the recommendation #2 may conflict with the ordinance that establish the mayor's spending authority, the ordinance in place says the mayor has authority to enter in to contract and spend monies up to a certain limit.

After discussion, Alderman Twillie made a motion to accept the Budget Committee recommendation. Second by Alderman Echols., Roll Call: Alderman Twillie-Yes, Alderman Echols-Yes, Alderman Fields-No, Alderman Hollowell-No, Alderman Capps-No, Alderman Breeding-No, Alderman Oswalt-Yes, Alderman Williams-Yes., Votes: Four-Yes, Four-No, No Action

A "Retreat" for the City Council, Mayor, City Clerk and Water Utility Manager was set for Saturday, January 10, 2015 at 8:30 a.m.

Veto Discussion

Alderman Echols made a motion to override veto #1 (Floyd Patton was demoted to CDL/Equipment Operator without supervisory responsibilities.). Second by Alderman Twillie. After Discussion, Roll Call: Alderman Twillie-Yes, Alderman Echols-Yes, Alderman Fields-Yes, Alderman Hollowell-No, Alderman Capps-Yes, Alderman Breeding-No, Alderman Oswalt-Yes, Alderman Williams-Yes., Votes: Six-Yes, Two-No. Motion Passed

Alderman Echols made a motion to override veto #2 (Roy Hamilton was demoted to laborer, and in approximately six months was moved back to CDL driver and later to cdl/relief heavy equipment operator, with pay to reflect the position and responsibility). Second by Alderman Oswalt. Roll Call: Alderman Twillie-Yes, Alderman Echols-Yes, Alderman Fields-No, Alderman Hollowell-No, Alderman Capps-No, Alderman Breeding-No, Alderman Oswalt-Yes, Alderman Williams-Yes., Votes: Four-Yes, Four-No. Motion Failed.

Alderman Echols made a motion to override veto #3 (J. C. Rice was demoted and placed as Pest Control Director, and is compensated when he fills in, in the absence of the Director as Assistant Director). Second by Alderman Twillie. After Discussion, Roll Call: Alderman Twillie-Yes, Alderman Echols-Yes, Alderman Fields-Yes, Alderman Hollowell-No, Alderman Capps-Yes, Alderman Breeding-Yes, Alderman Oswalt-Yes, Alderman Williams-Yes., Votes: Seven-Yes, One-No. Motion Passed.

Alderman Echols made a motion to override veto #4 (Wayne Ester is making the $8.50 tractor driver pay. There has not been a pay raise in the last four years -- only bonus pay of a $1,000.00 which equates to about .48 per hour). Second by Alderman Twillie. No Discussion, Roll Call: Alderman Twillie-Yes, Alderman Echols-Yes, Alderman Fields-Yes, Alderman Hollowell-No, Alderman Capps-Yes, Alderman Breeding-Abstained, Alderman Oswalt-Yes, Alderman Williams-Yes., Votes: Six-Yes, One-No, One-Abstained. Motion Passed.

Alderman Echols made a motion to override the veto #5 (Grant Long Jr. was hired in as part-time laborer, until we moved him to a full-time position at the $8.25 base pay. He was advised by then Director Patton that he could drive the tractor as needed and would be given .25 extra an hour when functioning as a tractor driver.). Second by Alderman Twillie. After Discussion, Roll Call: Alderman Twillie-Yes, Alderman Echols-Yes, Alderman Fields-No, Alderman Hollowell-No, Alderman Capps-No, Alderman Breeding-No, Alderman Oswalt-Yes, Alderman Williams-Yes., Votes: Four-Yes, Four-No. Motion Failed.

Mayor Bryant stated that the adjustment in the salaries will be made.

NEW BUSINESS

Request Permission to Bid on Demolition -- 430 Trenton Street

Mayor Bryant requested permission to bid on demolition-430 Trenton Street.

Motion was made by Alderman Capps to give the Mayor permission to bid on demolition of 430 Trenton Street. Second by Alderman Hollowell. Roll Call: All Ayes.

Alderman Oswalt expressed concerns regarding other burnt out houses/buildings that needed to be demolished. Alderman Oswalt requested a list of all properties that has been tagged and when they were tagged.

ANNOUNCEMENTS

Alderman Oswalt asked the Personnel Committee to meet Monday, January 19, 2015, time 5:30 p.m. in order to look at F.C. Water Dept. Policy verses the City of Forrest City Policy and to discuss a letter addressed to the mayor and the council from a former F.C. Water Dept. employee.

Alderman Twillie stated that a motion had to be made in order for the Mayor and the City Clerk to operate business as usual until a budget is established. Attorney Cline stated that he didn't see anything wrong in doing it. He said the only thing the state law says is that the City had to have a budget passed by February 1st.

Alderman Twillie made a motion to give authorization to Mayor and City Clerk to operate and do business as needed to get the bills paid until February 1, 2015. Second by Alderman Capps. Roll Call: Alderman Twillie-Yes, Alderman Echols-Yes, Alderman Fields-Yes, Alderman Hollowell-Yes, Alderman Capps-Yes, Alderman Breeding-Yes, Alderman Oswalt-Yes, Alderman Williams-Yes., Votes: All-Yes, Motion Passed

Mayor Bryant presented a plaque to Mr. Henry Peacock for 10 years of dedicated service as a City Alderman of the City of Forrest City.

Alderman Twillie made a motion to adjourn at 7:53 p.m.
